TERMS & CONDITIONS
Terms and Conditions — Last Updated: 7 September 2026
Welcome to Mega Salute Ship Design. By accessing or using this website, purchasing our products or services, or contacting us through the website, you agree to be bound by these Terms & Conditions. Please read them carefully before using our website.
1. ABOUT OUR WEBSITE
Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.
T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).
T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.
2. USE OF THE WEBSITE
Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
To learn more about this, check out our article “Creating a Terms and Conditions Policy”.
3. DESIGN SERVICES
Mega Salute Ship Design provides professional marine engineering and vessel design services. All services are performed with the highest industry standards, ensuring safety, efficiency, and compliance with maritime regulations. Scope of work is defined per project engagement.
4. DESIGN APPROVAL
The Client is responsible for reviewing and providing written approval for all design milestones. Approval signifies acceptance of the technical specifications and allows the project to move to the next development phase.
5. CLIENT RESPONSIBILITIES
Clients must provide all necessary information, technical data, and access to relevant resources required for the design process. Delays in providing information may result in adjustments to the project timeline.
6. PROJECT TIMELINES
All estimated delivery dates are provided in good faith. However, ship design is a complex process subject to regulatory changes and technical discovery. We will communicate any significant deviations from the agreed timeline promptly.
7. FEES AND PAYMENT
Fees are calculated based on the complexity and scope of the marine design project. Payment terms are typically structured around project milestones. Late payments may result in the suspension of design activities.
8. REVISIONS AND CHANGES
Minor adjustments are included within the initial scope. Substantial changes to the design brief or technical requirements after the project has commenced may require a contract addendum and additional fees.
9. INTELLECTUAL PROPERTY
All preliminary designs, engineering calculations, and blueprints generated by Mega Salute Ship Design remain our intellectual property until full payment is received, at which point usage rights transfer to the Client as specified in the individual contract.
10. CONFIDENTIALITY
Both parties agree to treat all technical and business information shared during the design process as strictly confidential. This obligation extends beyond the completion or termination of the project.
11. TERMINATION
Either party may terminate the design services agreement with 30 days' written notice. Upon termination, the Client shall pay for all work completed up to the termination date. All design materials remains the property of Mega Salute Ship Design until final settlement.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Mega Salute Ship Design shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the vessel designs. Our total liability is limited to the amount paid for the services.
13. INDEMNIFICATION
The Client agrees to indemnify and hold harmless Mega Salute Ship Design from any claims, damages, or legal expenses arising from the construction, operation, or misuse of the vessel after the design phase is completed.
14. WARRANTIES AND REPRESENTATIONS
We warrant that our designs are original and comply with the technical standards agreed upon at the start of the project. No other warranties, express or implied, regarding commercial success or specific operational performance are provided.
15. FORCE MAJEURE
Mega Salute Ship Design shall not be held responsible for delays or failure to perform obligations due to events beyond our reasonable control, including natural disasters, shipping strikes, or global infrastructure failures.
16. GOVERNING LAW
These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Sarawak, Malaysia.
17. DISPUTE RESOLUTION
In the event of a dispute, both parties agree to first attempt resolution through good-faith mediation before pursuing formal legal proceedings.
18. ENTIRE AGREEMENT
These Terms, along with any specific project contracts, constitute the entire agreement between Mega Salute Ship Design and the Client. Any changes must be made in writing and signed by both parties.
